General Conditions of Sale of BRITAVIT guest rooms (GCS)

Article 1 - Purpose

These general terms and conditions define the rights and obligations of the parties in the context of the remote reservation of services offered by our establishment, the contact details of which are specified in this reservation confirmation document. They govern all the steps necessary for the reservation and follow-up of the reservation between the contracting parties. The customer acknowledges having read and accepted these general terms and conditions of sale and the conditions of sale of the reserved rate accessible on our reservation platform. These general terms and conditions of sale apply to all reservations concluded online, via our reservation platform.

These General Terms and Conditions of Sale, the terms and conditions of sale for the rate reserved by the customer, and the reservation voucher or request express the entirety of the parties' obligations. No general or specific conditions communicated by the customer may be incorporated into these general terms and conditions. The documents forming the contractual commitments between the parties are, in descending order of priority, the reservation voucher or request (including the specific conditions of the reserved rate) and these general terms and conditions. In the event of a contradiction between the reservation voucher and the general terms and conditions, the provisions appearing on the reservation voucher will be the only ones applicable to the obligation in question. These general terms and conditions of online sale may be modified and/or supplemented at any time by the establishment. In this case, the new version of the general terms and conditions of online sale will be posted online by the establishment. As soon as it is posted online, the new version of the general terms and conditions of online sale will automatically apply to all customers.

These General Terms and Conditions of Sale (GTC) automatically govern the sales of stays in the 4 BRITAVIT guest rooms.

The tenant acknowledges having read and accepted these T&Cs prior to any reservation.


Article 2 - Reservation

The customer chooses the services presented on our booking platform. They acknowledge having read the nature, destination, and booking terms of the services available on our booking platform and having requested and obtained the necessary and/or additional information to make their booking with full knowledge of the facts. The customer is solely responsible for their choice of services and their suitability for their needs, such that we cannot be held liable in this regard. The booking is deemed accepted by the customer at the end of the booking process.

Booking process: Reservations made by the customer are made via the electronic reservation form accessible online on our reservation platform. The reservation is deemed to have been made upon receipt of the reservation form. The customer undertakes, prior to any reservation, to complete the information requested on the form or reservation request. The customer attests to the truthfulness and accuracy of the information provided. After the final choice of services to be reserved, the reservation procedure includes, in particular, entering the bank card in the event of a request for a guarantee or prepayment, consulting and accepting the general conditions of sale and the conditions of sale of the reserved rate before validating the reservation and, finally, the validation of the reservation by the customer.

Acknowledgment of receipt of the reservation: our reservation platform acknowledges receipt of the customer's reservation by sending an email without delay. In the case of online booking, the acknowledgment of receipt of the booking by email summarizes the contract offer, the services reserved, the prices, the conditions of sale relating to the selected rate, accepted by the customer, the date of the booking made, information relating to after-sales service, as well as the address of the seller's establishment to which the customer can submit complaints.


Article 3 – Conclusion of the contract

The reservation becomes effective once the tenant has paid 50% of the amount due. The rental agreement entered into between the parties to this agreement is nominative and may not under any circumstances benefit, even partially, third parties, whether natural or legal persons, unless with the written consent of the owner. Any breach of this last paragraph may result in immediate termination of the rental at the tenant's expense, with the rental proceeds remaining permanently acquired by the owner.

The rental is established for a capacity corresponding to that mentioned in the description of the rented room.


Article 4 – No right of withdrawal

For reservations made by mail, telephone or online, the tenant does not benefit from the withdrawal period, in accordance with article L221-28 of the consumer code relating in particular to accommodation services provided on a specific date or at a specific frequency.


Article 5 - Price

The price includes room rental, bed linen (beds made on arrival), and towels.

Baby equipment can be provided free of charge upon request (bed, high chair, bathtub) with the exception of sheets and blankets.

The price does not include the tourist tax of €0.61/adult person/night which must be paid with the balance at the end of the stay.


Article 6 - Payment

The tenant can pay for his stay

 Directly online in a secure manner on the website www.britavit.com

 By check payable to BRITAVIT

 By transfer to the lessor.


Article 7 - Arrival and departure

The tenant must arrive on the first day of their reservation between 5 p.m. and 7 p.m. In the event of a late or delayed arrival, the tenant must notify the landlord.

Check-out is before 11 a.m. The length of stay is determined at the time of booking. The tenant may not, under any circumstances, claim to remain on the premises after the stay.


Article 8 - Payment of the balance

The balance of the rental is paid at the end of the stay.

The paid services offered by the establishment which have been ordered will be payable with the balance at the end of the stay (electric bike rental, picnic baskets, evening meal boards).


Article 9 - Payment security

The lessor has chosen elloha.com/stripe.com to secure online credit card payments. The validity of the customer's payment card is verified by stripe.com. A payment card may be declined for several reasons: stolen card, blocked card, limit reached, or input error.

Entering the required banking information, as well as accepting these general terms and conditions and the voucher or booking request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature. The computerized records stored in the elloha.com computer systems. will be kept under reasonable security conditions and considered as proof of communications, orders and payments between the parties. The customer is informed that their IP address is recorded at the time of booking.

Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the tenant will result in the cancellation of the order.


Article 10 - Respect for privacy

The customer is informed, on each of the personal data collection forms, whether the responses are mandatory or optional by the presence of an asterisk. The information processed is intended for the establishment, elloha.com, its entities, its partners, its service providers (and in particular online payment providers). The customer authorizes elloha.com to communicate their personal data to third parties on the condition that such communication proves compatible with the performance of the operations incumbent on elloha.com.com under these general terms and conditions and in connection with the Customer Charter for the protection of personal data. In particular, when paying online, the customer's bank details must be transmitted by the payment service provider stripe.com to the establishment's bank, for the execution of the reservation contract. The customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection within the meaning of the Data Protection Act. However, the customer consents to this transfer, which is necessary for the execution of their reservation. Constellation SAS / Stripe.com, in their professional capacity, have undertaken to the establishment to take all security measures and respect data confidentiality for said data transfers.


Article 11 - Cancellation of reservation / Cancellation conditions:

 Between 60 and 31 days before the scheduled arrival date, no charge

 Between 30 and 15 days before the scheduled arrival date, 30% of the amount of the stay remains with the lessor

 Between 14 and 8 days before the scheduled arrival date, 50% of the amount of the stay remains with the lessor

 Less than 7 days before the scheduled arrival date, 100% of the amount of the stay remains with the lessor

 If the tenant does not show up on the scheduled arrival date (No show), 100% of the amount of the stay remains with the lessor.

 If the stay is shortened, 100% of the amount of the stay remains with the lessor.


Article 12 - Cancellation of reservation or modification by the lessor

In the event of force majeure or serious personal events affecting the lessor, a proposal for rehousing or postponement of the stay may be proposed.

If this offer is not suitable, the lessor agrees to refund the entire reservation. No compensation may be claimed.


Article 13 - Use of the premises

The tenant undertakes to respect the peaceful nature of the premises and to use them in accordance with their intended purpose.

The rooms and the entire establishment are non-smoking.

In the event of non-compliance with these conditions, the lessor may refuse the stay.


Article 14 - Household

The rooms are cleaned by the lessor at the end of the stay.


Article 15 - Swimming pool

A swimming pool, 8 m x 4 m, unheated, is shared and available to guests of the guest rooms as well as to guests of the Gîte CACHOU, from May 1 to September 30.

The pool is treated with sea salt obtained by crystallizing evaporated seawater. Through the process of saline electrolysis, the salt acts as a natural treatment, reproducing cleaner, softer seawater. A certificate of conformity with the safety requirements of standard NF P 90-308 has been issued for its protective element (bar cover).

Children remain under the supervision and responsibility of their parents.


Article 16 - Insurance and liability

The tenant is responsible for all damages caused by him.

It must be covered by civil liability insurance and can be insured by a holiday insurance contract for these risks.

The lessor cannot be held liable in the event of loss, theft or damage to personal belongings on the entire estate, both inside and outside.


Article 17 - Payment for other services

At the end of the stay, the tenant will have to pay for the paid services offered by the establishment such as bicycle rental, picnics, meal boards. The amount of these services was made known to the customer on the website and when they made their reservation.


Article 18 - Reception of animals

Pets are not allowed in the rooms or in the property's parking lot.

. In the event of non-compliance with this clause, the owner may refuse the stay: no refund will then be made.


Article 19 - Complaints / Disputes

The lessor listens to comments and suggestions made during the stay and favors direct communication.

These General Terms and Conditions of Sale are governed by the law of the country of establishment without prejudice to any mandatory protective provisions that may be applicable in the country of residence of consumers.
